源自北美的恢复性司法,与我国未成年人刑事司法的根本方针即教育、挽救、感化是基本一致的,但其理念和我国刑事司法的价值理念存在着不小的分野,因此,解读恢复性司法理念在中国未成年人刑事司法制度暗合与分野,具有现实意义。

Originated from the North America, the restorative justice is consistent with the basic principle of the juvenile criminal justice in our country, i.e. education, rehabilitation and emotional influence, while distinct division exists between its' idea and the values of criminal justice in our country, it is thus of practical significance to illuminate the coincidence and division of restorative justice ideas in the juvenile criminal justice system in our country.
