近年来,随着社会的不断发展,人们性观念的不断开放,大学生非婚生子现象受到社会广泛关注。由于女大学生身份特殊性、经济能力的限制及女大学生法律意识淡薄,女大学生非婚生子后弃婴问题越来越突出。我国法律对女大学生非婚生子后弃婴问题相关规定并不完善,没有系统规定对女大学生的救助体系,也没有规定全面、具体、可操作的弃婴救助制度,这使得女大学生和弃婴的各项合法权益无法得到保障。通过建立国家体系内的"弃婴岛"保护体系,加快出台《儿童福利法》,完善对遗弃罪的规定,建立完整的制度化救助流程,完善个人收养制度,依法设立临时收养中心,建立学校强制报告制度等措施。完善相关法律制度,最大限度地保障女大学生和婴儿的生命健康权及其他各项合法权益。

With the social development and people's open-oriented attitude towards sex in recent years, the phenomenon of illegitimate babies born by female college students has attracted more and more social attention. What is getting increasingly serious is the problem of illegitimate babies born and abandoned by female college students due to their special identity, limited economic ability and weak legal awareness. There are imperfections in the current national legal provisions connected with issue of illegitimate babies born and abandoned by female college students, there are no systematic stipulations on legal assistance organizations tailored to them and no provision of comprehensive, specific and workable abandoned baby rescue system, which lead to the result of the legitimate rights and interests of female college students and abandoned babies cannot be guaranteed. So it is unnecessary to introduce measures, such as to establish "baby hatch" protection system within the state institutions, speed up the introduction of "Children Welfare Act", perfect the regulations on crime of abandonment, set up complete and systematic saving and assistant procedure, complete the individual adoption system, build temporary adoption center according to law, create compulsory report mechanism in schools and so on, in order to complete the legal system and protect to the maximum extent the rights of life and health and other legal rights and interests of female college students and babies.
